The price of Digital Content will be shown before you complete your purchase. Prices will state whether VAT is included or payable in addition, and the total amount payable will be shown before your order is completed.

Payment must be received in full before access to Digital Content is provided unless we have agreed otherwise.

Submitting an order constitutes an offer to purchase the Digital Content. A contract is formed when we accept your order and confirm the purchase.

We may decline or cancel an order before acceptance where, for example, Digital Content is unavailable or an obvious pricing or technical error has occurred. Where payment has already been taken, it will be refunded.

This section applies where you purchase Digital Content as a consumer, meaning an individual acting wholly or mainly outside their trade, business, craft or profession.

If you are purchasing Digital Content on behalf of a school, academy trust, company, charity or other organisation, these statutory consumer cancellation rights will not normally apply.

Consumers normally have a 14-day cancellation period for online purchases.

Where you choose to receive Digital Content immediately, you expressly consent to Firebird beginning supply before the end of the 14-day cancellation period and acknowledge that you will lose your statutory right to cancel once supply of the Digital Content has begun.

If you are purchasing as a consumer and wish to retain your 14-day cancellation right, please contact us before purchasing at info@firebirdltd.co.uk. We can arrange for the Digital Content to be supplied after the cancellation period has expired.

Once supply of Digital Content has begun, we do not normally offer refunds unless required by law or otherwise agreed by Firebird.

Nothing in these Terms affects any statutory rights you may have under the Consumer Rights Act 2015, including rights relating to Digital Content that is faulty, not as described or does not otherwise meet the standards required by law.

When you purchase Digital Content, Firebird grants you a non-exclusive, non-transferable license to use it:

• for your personal use; or
• where purchased by an organisation, for that organisation’s own internal purposes.

Unless we agree otherwise in writing, Digital Content purchased for one school, organisation or legal entity may not be shared with or used by another school, organisation or legal entity, including another organisation within the same group or multi-academy trust.

You must not, without our prior written permission:

• copy or reproduce Digital Content other than as reasonably necessary for its permitted internal use;
• sell, resell or commercially exploit Digital Content;
• distribute or make Digital Content available to third parties;
• sub-license Digital Content; or
• share login details, download links or other access credentials.

Any additional license arrangements agreed with Firebird in writing will take precedence over this section where they are inconsistent with it.

Firebird provides data protection, privacy, AI governance and related compliance consultancy and guidance.

Unless expressly agreed otherwise in writing, information published on this website and Digital Content supplied by Firebird is provided for general guidance, educational and compliance-support purposes and does not constitute legal advice.

You remain responsible for deciding how information and resources are applied within your organisation and for obtaining independent legal or other professional advice where appropriate.

We take reasonable steps to maintain the security and availability of this website and our Digital Content.

For purchases of Digital Content, the terms applying at the time the contract is formed will normally continue to apply to that purchase.

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales.

Where you are purchasing in the course of a business, the courts of England and Wales will have exclusive jurisdiction.

If you are a consumer living in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts.
